ScreenInterview Terms & Conditions

These Software Terms & Conditions (“Terms”) are a legal agreement between you (“Customer,” “you,” or “your”) and ScreenInterview a United States–based company (“ScreenInterview,” “we,” “us,” or “our”).

These Terms govern your access to and use of ScreenInterview’s AI-powered screening and interview software, websites, APIs, and related services (collectively, the “Services”).

BY ACCESSING OR USING THE SERVICES, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.


1. Our Services

ScreenInterview provides AI-powered tools that conduct, analyze, and summarize screening interviews to support recruitment and hiring decisions. The Services are designed to support human decision-making and do not make final hiring or employment decisions.


2. Eligibility and Authority

You must be at least 18 years old to use the Services. If you accept these Terms on behalf of an organization, you represent that you have authority to bind that organization.


3. License Grant

Subject to these Terms, ScreenInterview grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services solely for your internal business recruitment and evaluation purposes.


4. Restrictions

You may not:

  • Reverse engineer, decompile, or attempt to extract source code
  • Use the Services to build or benchmark a competing product
  • Scrape, crawl, or harvest data using automated tools
  • Circumvent security or access controls
  • Introduce malware or harmful code
  • Use the Services in violation of applicable laws

We may suspend or terminate access at any time for violations.


5. Customer Responsibilities

You are responsible for:

  • Ensuring lawful use of the Services
  • Providing required notices and obtaining candidate consent
  • Ensuring human oversight of AI-generated outputs
  • Compliance with employment, labor, and anti-discrimination laws

ScreenInterview is not responsible for hiring decisions made using the Services.


6. Data Roles

  • ScreenInterview acts as a data processor for candidate data processed on your behalf.
  • ScreenInterview acts as a data controller for its own business data (billing, analytics, security).

Personal data handling is governed by our Privacy Policy and any applicable Data Processing Addendum (DPA).


7. AI Use and Outputs

The Services may generate transcripts, summaries, scores, or insights using automated processing.

You acknowledge that:

  • AI outputs may contain inaccuracies
  • Outputs are not determinative and must be reviewed by humans
  • Final decisions remain your responsibility

8. Intellectual Property

ScreenInterview owns all rights, title, and interest in the Services, software, models, and documentation. You retain ownership of data you submit. You grant ScreenInterview a license to process such data solely to provide and improve the Services.


9. Confidentiality

Each party agrees to protect the other’s confidential information and use it only as necessary to perform under these Terms.


10. Fees and Payment

Fees, billing cycles, and payment terms are defined in your order form or subscription plan. All fees are non-refundable unless expressly stated otherwise.


11. Security

We maintain reasonable technical and organizational safeguards designed to protect data against unauthorized access, loss, or misuse.


12. Term and Termination

These Terms remain in effect while you use the Services.

We may suspend or terminate access:

  • For breach of these Terms
  • For non-payment
  • To comply with law
  • To protect platform integrity

Upon termination, your right to use the Services ends immediately.


13. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.


14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE THREE (3) MONTHS PRECEDING THE CLAIM OR $100 USD, WHICHEVER IS GREATER

15. Indemnification

You agree to indemnify and hold harmless ScreenInterview from claims arising from:

  • Your misuse of the Services
  • Your hiring decisions
  • Violation of applicable laws

16. Arbitration and Class Action Waiver

Any dispute will be resolved by binding arbitration under the Federal Arbitration Act. You waive the right to participate in class or representative actions.


17. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.


18. Changes to These Terms

We may update these Terms from time to time. Continued use constitutes acceptance of the updated Terms.
